Most Americans Want Medical Cannabis Dispensaries to Stay Open During Lockdown

The poll , conducted by YouGov earlier this week, asked nearly 5,400 Americans whether medical marijuana dispensaries should be considered “essential services” or not. Slightly over half (53 percent) of all respondents agreed that access to medical marijuana was essential, and only 26 percent said that dispensaries should not be considered essential. A further 21 percent were undecided on the matter. As is often the case with cannabis-related polls , younger and more liberal respondents were more likely to be in favor of keeping dispensaries open. Between 54 and 59 percent of respondents between the ages of 18 and 54 agreed that medical marijuana is an essential service, but only 47 percent of those over 55 felt the same way. That’s the question the New Mexico Taxation and Revenue Department has asked the state’s high court. On behalf of TRD, the state’s Attorney General’s office filed a petition Monday with the New Mexico Supreme Court asking for clarification about whether medical cannabis is exempt from gross receipts tax, like prescription drugs. In 2014, New Mexico cannabis producer Sacred Garden asked the TRD for a refund on the gross receipts tax the company paid that year. That request was denied by TRD. But the state Court of Appeals agreed with the cannabis company and ruled that medical cannabis indeed qualifies for the same tax exemption as prescription drugs. In the state’s petition to the state Supreme Court, Special Assistant Attorney General Cordelia Friedman argued that because federal law prevents doctors from writing prescriptions for cannabis, it does not fall under the same tax exempt...

Virginia Lawmakers Send Marijuana Decriminalization Bill To Governor’s Desk

After both chambers of the legislature passed similar but separate versions of the reform proposal last month , they convened a conference committee to resolve differences between their bills. Following a reconciliation in the language, the House of Delegates voted 56-36 to approve the final version and the Senate approved it by a 27-12 tally. Gov. Ralph Northam (D) is supportive of decriminalization and is expected to sign it into law. When the new policy goes into effect, possession of up to one ounce of cannabis will be punishable by a $25 fine and no threat of jail time. Under current law, simple possession is punishable by a maximum $500 fine and up to 30 days in jail. But what happens when legal CBD use results in failed drug tests for law enforcement officers? According to New Mexico’s KOAT News , that’s exactly what’s happening in the Albuquerque Police Department, with ranking officers blaming over-the-counter CBD products for local cops’ failed pot tests. “You'll have a police officer go to their doctor and their doctor will tell them, 'You should try CBD.
