We’ll continue to update as regulators announce new policies. So far, during the COVID-19 pandemic, cannabis sales are through the roof as consumers stock up in anticipation of supply chain disruption. But, despite this upswing, cannabis companies are bracing for impact. As Cannabis Wire reported this week, a dilemma has hit the nascent industry: to close or not to close? Already, Canopy Growth chose to close nearly two dozen shops in Canada, and we’re tracking how other companies are reacting. But what happens in the case of forced closures? Cannabis regulators will have to weigh tough decisions in the coming days as businesses, from gyms to bowling alleys to bars, are asked to close as part of broader efforts to contain the spread of the virus. (While Canadian consumers can legally order cannabis online, should closures occur, changes are taking place north of the border. On...

Washington Governor Signs Bill To Diversify State’s Marijuana Industry
(Cannabis, Colorado, Connecticut, Illinois, Law, Legalization, Massachusetts, Michigan, New Jersey, New York, Pennsylvania, Processing, Production, United States, Washington, Dispensaries) In an effort to ensure the spoils of marijuana legalization are available to everyone, Washington State Gov. Jay Inslee (D) signed a bill on Tuesday to allow state regulators to funnel unused marijuana business licenses to people from communities that have been negatively impacted by the drug war. The legislation came at the request of state cannabis regulators, who have pointed out that Washington’s legalization law, which voters approved in 2012, failed to include any provisions aimed at addressing past prohibition harms. The new law signed by Inslee aims to diversify the industry by issuing more business licenses to people negatively affected by drug law enforcement and providing them with technical assistance to get their companies off the ground. It creates a state Marijuana Equity Task Force and allows the Washington State Liquor and Cannabis Board (LCB) to grant forfeited, canceled, revoked or otherwise unissued marijuana business licenses to qualified equity applicants. “HB...

Cannabis Municipal Bonds Could Be The Future
(Alcohol, Arizona, Banking, Cannabis, Colorado, Connecticut, Consulting, Development, Education, Exploring, Growing, Investments, Investors, Iowa, Legalization, Minnesota, Missouri, Montana, New Jersey, New York, Products, Regulations, Tobacco, United States, Vermont) MPG Consulting has recently authored a report looking at the potential of Cannabis Municipal Bonds (CMB). Adam Orens, Founder of MPG and Sal Barnes, Managing Director, MPG have conducted a theoretical analysis using Colorado showing how the state can translate its cannabis revenue into a short-term bond amount of $166 million and long-term bond issued in the amount of $591 million resulting in $123 million and $438 million available for educational initiatives and infrastructure, respectively. States and municipalities already use revenue bonds as a way to pay for large projects. The investors of such bonds feel that the risk for these investments is lower since there is a captive source of revenue to pay the interest. The report gives Iowa as an example. That state allocates $55 million in gaming taxes every year to pay the debt on revenue bonds that were issued in 2009 and 2010. That money raised selling these bonds was then used for community revitalization, flood mitigation, and...

Tupac Detective Calls for Arrest of "Self-Confessed" Murder Accomplice Keffe D
(California, Law, New Jersey, United States) In 1996, legendary rapper Tupac Shakur was murdered in Las Vegas during a drive-by shooting. And now, one of the cops originally assigned to investigate both Tupac and the Notorious BIG’s deaths is demanding the immediate arrest of a gang leader who claims to have been an accomplice in Tupac’s murder. Last week, former LAPD officer Greg Kading said during an interview with The Sun that Las Vegas police should arrest Duane “Keefe D” Davis (sometimes spelled "Keffe D") for his alleged participation in Tupac’s death. "He has confessed publicly multiple times about his role in the murder of Tupac,” Kading said . “And I cannot think of any case in American crime history where a confessing murderer is allowed to continue and go speak blatantly about his involvement in a crime. It is unprecedented.” In recent years, Keffe D has, in fact, claimed in books and documentaries that he was partially responsible for Tupac’s death. Officer Kading also possesses LAPD archived audio recordings of his...

Marijuana Legalization ‘Not Likely’ In New York Budget, Governor Says On Eve Of Deadline
(Arizona, California, Cannabis, Connecticut, Events, Legalization, Medical Marijuana, Missouri, Nebraska, New Jersey, New York, Oregon, Regulations, United States, Washington) Marijuana legalization is “not likely” to be included in the final budget in New York, Gov. Andrew Cuomo (D) said on Tuesday, explaining that the issue proved too complicated as the state grapples with the coronavirus. Another sign that the policy change isn’t happening as Cuomo and advocates had planned comes from a pair of newly revised budget bills that exclude the proposal, making it all but certain that legalization won’t make the final cut. “Too much, too little time,” the governor said of the proposal during a press conference. Watch Cuomo’s cannabis comments in the video below: Later in the day, Cuomo expanded on why legal cannabis likely would be left out of the budget in a radio interview. “We’re not going to get there. I don’t believe we get there because in truth that is something that had to be talked through and worked through, and the legislature wasn’t here. I was doing this COVID virus,” he told WAMC’s Alan Chartock. “That requires time to do it right.” “That is not a...

New York Governor Confirms Cannabis Legalization By Budget “Not Likely”
(Cannabis, Connecticut, Legalization, New Jersey, New York, Pennsylvania, Regulations, United States) Editor’s note: This story was updated to reflect a statement made by New York Governor Andrew Cuomo on Tuesday. Legalization by budget in New York is all but dead. As hours remained before the state budget deadline, New York Governor Andrew Cuomo confirmed during a Tuesday press conference about COVID-19 that adult use cannabis legalization through the budget is “not likely.” When asked by a reporter whether there was a budget deal that included legalization, Cuomo said it was “not likely,” adding that there is “too much, too little time.” Key lawmakers involved in budget negotiations signaled to Cannabis Wire similar sentiments: that legalization is a no-go, at least for now. Sen. Liz Krueger, who represents the east side of Manhattan, is perhaps the single strongest cannabis legalization supporter in the legislature. When asked Monday where legalization discussions stood hours before the budget deadline on April 1, Krueger’s spokesperson Justin Flagg told Cannabis Wire, “Well,...

Declaring CB ‘essential’ marks a watershed moment in history
(California, Cannabis, Colorado, Illinois, Massachusetts, Medical Marijuana, Michigan, Nevada, New Jersey, New York, Ohio, Pennsylvania, Stocks, United States, Washington, Dispensaries) Declaring CB ‘essential’ marks a watershed moment in history The COVID-19 pandemic has forced government officials to make life-or-death decisions about which goods and services are essential, and which are not. Essential businesses stay open; those not on the list must close to the public. In state after state, and province after province, regulators have declared medical marijuana essential. This is a watershed moment worth noting. In California, New York, Washington, Illinois, Massachusetts, Colorado, Nevada, Michigan, New Jersey, Pennsylvania, and Ohio, governors have closed non-essential businesses, but specifically allowed medical (and sometimes adult-use) cannabis dispensaries to remain open. The 2018 Farm Bill gives the US Department of Agriculture (USDA) regulatory authority over hemp cultivation at the federal level. In turn, states have the option to maintain primary regulatory authority over the crop cultivated within their borders by submitting a plan to the USDA. This federal and state interplay has resulted in many legislative and regulatory changes at the state level. Indeed, most states have introduced (and adopted) bills that would authorize the commercial production of hemp within their borders. A smaller but growing number of states also regulate the sale of products derived from hemp. In light of these legislative changes, we are presenting a 50-state series analyzing how each jurisdiction treats hemp-...

Most Americans Want Medical Cannabis Dispensaries to Stay Open During Lockdown
(Alcohol, Arizona, California, Cannabis, Colorado, Connecticut, Delaware, Florida, Hawaii, Illinois, Legalization, Louisiana, Maine, Maryland, Massachusetts, Medical Marijuana, Mexico, Michigan, Nebraska, Nevada, New Jersey, New Mexico, New York, Ohio, Oregon, Pennsylvania, Rhode Island, United States, Washington, Dispensaries) Most Americans believe that states should not restrict access to legal medical cannabis during “shelter-in-place” measures, according to a new poll . The poll , conducted by YouGov earlier this week, asked nearly 5,400 Americans whether medical marijuana dispensaries should be considered “essential services” or not. Slightly over half (53 percent) of all respondents agreed that access to medical marijuana was essential, and only 26 percent said that dispensaries should not be considered essential. A further 21 percent were undecided on the matter. As is often the case with cannabis-related polls , younger and more liberal respondents were more likely to be in favor of keeping dispensaries open. Between 54 and 59 percent of respondents between the ages of 18 and 54 agreed that medical marijuana is an essential service, but only 47 percent of those over 55 felt the same way. Democrats were also more likely (62 percent) to agree than independents (52 percent) or Republicans (43 percent...

Americans Want Medical Marijuana Dispensaries To Stay Open As ‘Essential Services,’ Poll Finds
(California, Cannabis, Colorado, Illinois, Maryland, Massachusetts, Medical Marijuana, Nebraska, New Jersey, New York, Oregon, Products, Recreational, South Dakota, United States, Washington, Dispensaries) A majority of Americans believe that medical cannabis dispensaries should be kept open as “essential services” amid the coronavirus pandemic, according to a new poll. YouGov. As state governments across the country grapple with the COVID-19 outbreak, officials have had to make difficult decisions about which businesses are critical enough to remain open and which should be forced to temporarily shut down. In many states with legal cannabis—including California, Colorado, Illinois, Maryland, Massachusetts and New Jersey—officials have determined that medical marijuana dispensaries are, in fact, essential services that can continue to operate. Colorado Attorney Discusses ‘New Normal’ in Cannabis Industry
(Cannabis, Colorado, Compliance, Facilities, Law, Massachusetts, Media, New Jersey, New York, Regulations, Regulatory Compliance, Retail Stores, Social Media, United States, Websites, Dispensaries, Cultivation) Recent coronavirus response measures in Denver and Colorado have been keeping attorney Alyson Jaen’s attention lately as the industry works to maintain compliance. At 5 p.m. MDT on March 24, Denver’s stay-at-home order went into effect in response to the coronavirus. The previous day, Mayor Michael Hancock said adult-use businesses and liquor stores are nonessential, but reversed course a few hours later after an “outcry” and let the businesses remain open, according to The New York Times .Facing orders to stay in their homes and the possibility of not being able to purchase product when they do leave their homes, demand among adult-use customers increased 140% on March 23 before the mayor said adult-use businesses are essential, said Jaen, who is head of Denver-based Fortis Law Partners’ cannabis practice.“It was in a matter of hours [that] we had a huge pivot—'Yes, you're open,' 'No, you're not.’” she said. “That creates confusion and this idea of panic-buying.”Previously, on March...

But the shutdowns have prompted perhaps an unexpected question amid the coronavirus chaos: Are medical marijuana operations considered “essential” in this new public arena? For many areas across the U.S., the answer is a resounding “yes.”Over in San Francisco, though, that wasn’t always the case. All seven counties in the Bay Area of California implemented a shelter-in-place order March 16. The order, which is in place until at least April 7, included a list of essential services that could remain open but left room for interpretation regarding other businesses, including...

Mondaq- Clyde & Co Article: United States: States’ Cannabis Legalization Legislation Outpaces Availability Of Insurance Coverage
(Banking, California, Cannabis, Cannabis and Hemp, Growing, Hemp, Insurance Companies, Law, Legalization, Medical Marijuana, New Jersey, Products, Recreational, United States, Washington, Financial Services) by Vikram Sidhu , Cheryl Yakey , Jared Wilner and Megan Kuzniewski Clyde & Co As of February 2020, cannabis is legal for adults over the age of 21 in eleven states and Washington D.C. As of February 1, 2020, cannabis is legal for recreational and medical use by adults over the age of 21 in 11 states and Washington D.C., and is legal for medical use in 33 states. These numbers are likely to increase substantially in the next few years as more than half the states have pending legislation legalizing cannabis for some use or decriminalizing the drug. Currently, there are bills pending in 20 states to allow adult recreational use, 10 states to decriminalize simple possession, and 12 states with bills to create comprehensive medical cannabis programs, with some overlap among these three categories. Yet, despite the rapid expansion that the cannabis market continues to experience, the cannabis industry continues to face substantial obstacles, inter alia, in meeting its needs for the...

Despite Coronavirus, New York’s Governor Is Still Pushing for Weed Legalization
(Cannabis, Connecticut, Legalization, New Jersey, New York, United States, Washington) Photo via As confirmed cases of COVID-19 continue to climb in every state across the country, New York, in particular, has been hit hard by the virus. The Empire State currently has the second highest number of infected residents after Washington State, and those figures are only climbing. But while New Yorkers continue to self-isolate and social distance in an effort to slow the pandemic spread, Governor Andrew Cuomo and other lawmakers are still working hard to pass a comprehensive budget before the April 1st deadline. And despite the global crisis, Cuomo is adamant that the new budget will still include a provision to legalize adult-use cannabis . According to the New York Daily News , Governor Cuomo held a press conference Monday and told residents and reporters that in addition to ending cannabis prohibition in the Big Apple and beyond, he would continue to pursue a $30 million environmental bond, and — in a less progressive move — try to roll back some of the state’s newly-...

New Jersey Supreme Court Rules Employers Must Accommodate Workers’ Off-Duty Medical Cannabis Use
(Alcohol, Cannabis, Connecticut, Delaware, Drug Testing, Law, Medical Marijuana, New Jersey, New York, Pennsylvania, Recreational, Testing, United States) The New Jersey Supreme Court ruled March 10 that employers must accommodate workers’ off-duty medical cannabis use in a decision that marks a shift in the courts’ view of medical cannabis in the state, according to Pashman Stein Associate Dillon McGuire.Justin Wild, a former funeral director for Feeney Funeral Home, had been treating his cancer with medical cannabis for a year without receiving any negative performance evaluations from his employer. When Wild had a minor car accident while on duty, Feeney Funeral Home tested him for drugs and alcohol as part of their company policy.“At that time, he said, ‘Look, I have this medical marijuana card. I guarantee my test will be positive for marijuana, but it’s prescribed. I’m using it at home, after work hours,’” McGuire, whose firm was an amicus on the case, representing the ACLU and arguing on behalf of the plaintiff, told Cannabis Business Times. When Wild failed the drug test, Feeney Funeral Home terminated him, prompting him to file...

Does the Hotel Industry Benefit from Cannabis Legalization? Research Suggests So.
(California, Cannabis, Colorado, Legalization, Management, Nevada, New Jersey, New York, Oklahoma, Pennsylvania, Recreational, Research, United States, Washington, Cultivation, Real Estate) The story of cannabis legalization is, in part, a real estate story, as cannabis business owners buy and rent storefront property, scope out cultivation spaces, and engage with zoning boards. Today, eleven states and Washington, D.C. have legalized adult use cannabis, and a number of efforts to legalize by ballot or by legislature are underway, from New Jersey and New York to Oklahoma. How does legalization affect the hotel industry? John O’Neill, a professor at Pennsylvania State University’s School of Hospitality Management, has published research seeking to better understand how hotels perform after legalization. O’Neill is also the director of the Hospitality Real Estate Strategy Group at Penn State, which focuses on teaching, outreach and research on the hospitality industry. The Group counts among its advisors executives from companies like Hilton and Marriott International. O’Neill focused primarily on Denver, Colorado, the first jurisdiction in the US with legal adult use...
