The 2018 Farm Bill gives the US Department of Agriculture (USDA) regulatory authority over hemp cultivation at the federal level. In turn, states have the option to maintain primary regulatory authority over the crop cultivated within their borders by submitting a plan to the USDA. This federal and state interplay has resulted in many legislative and regulatory changes at the state level. Indeed, most states have introduced (and adopted) bills that would authorize the commercial production of hemp within their borders. A smaller but growing number of states also regulate the sale of products derived from hemp. In light of these legislative changes, we are presenting a 50-state series analyzing how each jurisdiction treats hemp-...

Virus Not Stopping Nebraska Medical Marijuana Ballot Initiative
(Arizona, Cannabis, Events, Law, Medical Marijuana, Nebraska, United States) By Grant Schulte, Associated Press (AP) — Nebraska voters may still get a chance to legalize medical marijuana and casino gambling even though the new coronavirus (COVID-19) has forced activists to stop collecting signatures to place the issues on the November ballot. Organizers from both campaigns said they’re confident they’ll have enough signatures to qualify before the July 2 deadline to submit their petitions, even though they’ve pulled their circulators off the streets. Both groups said they had already gathered a large number before the pandemic forced the closure of public buildings and cancellation of major events where circulators often work. “I’m still optimistic,” said Sen. Anna Wishart, a co-chairwoman of Nebraskans for Medical Marijuana. “It’s a popular issue, and we’ve got a really good base of signatures. I feel really positive about where we are right now.” Because the measures are proposed constitutional amendments, the petition campaigns need signatures from at...

Missouri Marijuana Legalization Campaign In Jeopardy Due To Coronavirus
(Arizona, California, Cannabis, Events, Exploring, Law, Legalization, Medical Marijuana, Missouri, Nebraska, Oregon, United States, Washington) Coronavirus has dealt another blow to the marijuana reform movement. This time, activists in Missouri announced on Saturday that their effort to put a cannabis legalization measure on the ballot has “no practical way” of succeeding amid the pandemic. In recent weeks, the outbreak of COVID-19 has resulted in business closures and increased calls for social distancing in states across the country. That has made mass signature gathering for drug policy reform measures virtually impossible. “Unfortunately, while there is widespread support from Missourians to tax and regulate marijuana, there is currently no practical way during the COVID-19 outbreak to safely, publicly gather the 170,000 plus signatures needed over the remaining 6 weeks to put this on the Missouri ballot in 2020,” John Payne, campaign manager for Missourians for a New Approach, said. He added that the group is still “exploring our options at this point” but if it ultimately cannot find a path to the ballot for this...

Most Americans Want Medical Cannabis Dispensaries to Stay Open During Lockdown
(Alcohol, Arizona, California, Cannabis, Colorado, Connecticut, Delaware, Florida, Hawaii, Illinois, Legalization, Louisiana, Maine, Maryland, Massachusetts, Medical Marijuana, Mexico, Michigan, Nebraska, Nevada, New Jersey, New Mexico, New York, Ohio, Oregon, Pennsylvania, Rhode Island, United States, Washington, Dispensaries) Most Americans believe that states should not restrict access to legal medical cannabis during “shelter-in-place” measures, according to a new poll . The poll , conducted by YouGov earlier this week, asked nearly 5,400 Americans whether medical marijuana dispensaries should be considered “essential services” or not. Slightly over half (53 percent) of all respondents agreed that access to medical marijuana was essential, and only 26 percent said that dispensaries should not be considered essential. A further 21 percent were undecided on the matter. As is often the case with cannabis-related polls , younger and more liberal respondents were more likely to be in favor of keeping dispensaries open. Between 54 and 59 percent of respondents between the ages of 18 and 54 agreed that medical marijuana is an essential service, but only 47 percent of those over 55 felt the same way. Democrats were also more likely (62 percent) to agree than independents (52 percent) or Republicans (43 percent...

Oregon Drug Decriminalization And Treatment Campaign Impacted By Coronavirus
(California, Cannabis, Exploring, Legalization, Medical Marijuana, Nebraska, New York, Oregon, Recreational, South Dakota, United States, Washington) Another drug policy reform campaign has suspended signature gathering amid the coronavirus. This time, Oregon activists hoping to put a drug decriminalization and substance misuse treatment initiative on the state’s November ballot announced that they have ended in-person signature collections for the time being. But the campaign stressed there are other means for supportive voters to help qualify the measure. The Drug Addiction Treatment and Recovery Act places an emphasis on expanding drug treatment programs through the use of funds derived from existing marijuana tax revenues. At the same time, it would promote treating drug addiction as a health issue by decriminalizing illegal substances. Low-level possession would instead be considered a civil infraction punishable by a maximum $100 fine and no jail time. Since signatures can’t be collected in person, the campaign is urging residents to visit their website, enter their contact information, download the petition and mail it back...

Psychedelics Advocates Fight to Keep Ballot Initiatives Alive During Pandemic
(California, Cannabis, Consulting, Legalization, Media, Medical Marijuana, Nebraska, New York, Oregon, Social Media, United States, Washington, Washington DC) Two major psychedelics reform advocacy groups in Oregon and California are struggling to keep their ballot initiatives alive amidst coronavirus quarantine. In Oregon, activists have been collecting signatures for the Psilocybin Services Initiative (IP34), a ballot measure to fully legalize psilocybin for psychedelic-assisted therapy. If passed, this initiative would allow licensed businesses to produce psilocybin mushrooms, which could be legally used by adults under medical supervision. Activists managed to collect nearly 128,000 signatures before “shelter-in-place” measures came into effect. Oregon only requires 112,020 valid signatures to place a measure on a general election ballot, but activists were hoping to collect an additional 15,000 signatures in order to ensure that their measure is a success. Before any measure can be approved, state officials must verify every single signature on the ballot, and in most cases, thousands of signatures are ruled as invalid. For this reason...

Americans Want Medical Marijuana Dispensaries To Stay Open As ‘Essential Services,’ Poll Finds
(California, Cannabis, Colorado, Illinois, Maryland, Massachusetts, Medical Marijuana, Nebraska, New Jersey, New York, Oregon, Products, Recreational, South Dakota, United States, Washington, Dispensaries) A majority of Americans believe that medical cannabis dispensaries should be kept open as “essential services” amid the coronavirus pandemic, according to a new poll. The survey asked simply: “Do you believe medical marijuana dispensaries should or should not be considered essential services?” Fifty-three percent said the cannabis providers should be regarded as essential, 26 percent said they shouldn’t and 21 percent said they didn’t know. YouGov. As state governments across the country grapple with the COVID-19 outbreak, officials have had to make difficult decisions about which businesses are critical enough to remain open and which should be forced to temporarily shut down. In many states with legal cannabis—including California, Colorado, Illinois, Maryland, Massachusetts and New Jersey—officials have determined that medical marijuana dispensaries are, in fact, essential services that can continue to operate. Many states have also given the “essential” designation to recreational...

Oregon Campaign To Legalize Psilocybin Mushrooms For Therapeutic Use Hits Snag Amid Coronavirus
(California, Cannabis, Consulting, Medical Marijuana, Nebraska, New York, Oregon, Recreational, South Dakota, United States, Washington) A campaign to legalize psilocybin mushrooms for therapeutic purposes in Oregon is one of the latest drug policy reform efforts to say it’s hit a hitch amid the coronavirus outbreak. Activists have collected almost 128,000 signatures for the proposed initiative , which would allow individuals to access the psychedelic under medical supervision to aid in the treatment of mental health conditions. That raw total is more than the required number to qualify for the November ballot, but the campaign says it still wants to collect about 15,000 more signatures by July to be certain it has enough valid submissions to make the cut. Sam Chapman, campaign manager for the Psilocybin Services Initiative, said in a Facebook post on Tuesday that the group is “incredibly close” to making the ballot, but the pandemic “puts all of our progress in jeopardy.” In order to ensure that the initiative prevails under current circumstances, Chapman said the group is asking residents to fill out an electronic...

South Dakota Marijuana Legalization Campaign Urges Absentee Voting Amid Coronavirus
(California, Cannabis, Events, Legalization, Media, Medical Marijuana, Nebraska, New York, Recreational, Social Media, South Dakota, United States, Washington, Recreational Cannabis) A campaign working to pass separate measures to legalize marijuana for medical and recreational purposes in South Dakota announced on Sunday that it will be shifting its strategy in the weeks ahead due to the coronavirus outbreak. And it is urging voters to consider absentee ballot options as a way to make sure their voices can be heard in case the COVID-19 pandemic prevents people from going to their polling places come November. In a Facebook post, New Approach South Dakota said it had planned to do in-person outreach and host events to spread the word about the two initiatives, which qualified for the November ballot earlier this year . But now, activists have “set that on the back burner for now & are focusing on reaching you all through social media.” The group said it will host virtual town hall events, remotely broadcast guest speakers and create more editorial content. They’ll also hold weekly Q&A sessions every Monday. Further, New Approach South Dakota said it is...

Coronavirus Is Killing Weed Legalization Bills Across the US
(Cannabis, China, France, Iran, Italy, Law, Legalization, Medical Marijuana, Nebraska, New York, Ohio, Recreational, Spain, United States) As the COVID-19 pandemic consumes every waking — and sleeping — moment right now, marijuana legalization bills that had excellent chances at becoming law are instead getting shelved. State lawmakers across the US are suspending their legislative sessions for weeks or months to prevent the spread of the novel coronavirus, even as progressive states deem marijuana businesses as “essential services” alongside emergency responders and pharmacies amid the pandemic. Cannabis reform bills aren’t being singled out for delays, but rather they are no longer prioritized as states attempt to control the coronavirus crisis that threatens the lives of millions of at-risk individuals and the nation’s economy. Last week, New York State’s chances of making progress on its recreational legalization bill stalled as legislators scrambled to restructure the state’s budget to address coronavirus containment, diagnosis, and treatment. Of all US states, New York has reported the highest number of confirmed...

Key New York Senator Says No Need To Rush Marijuana Legalization Amid Coronavirus
(California, Cannabis, Legalization, Medical Marijuana, Nebraska, New York, United States, Washington) New York lawmakers will likely have to take up marijuana legalization after the coronavirus threat it neutralized, a key senator told Marijuana Moment on Friday. While Gov. Andrew Cuomo (D) has urged legislators to include legalization language in the annual budget, the pandemic has shifted legislative priorities. Sen. Liz Krueger (D), the sponsor of a recently revised reform bill , signaled earlier this week that the state’s need to respond to the public health crisis would mean that advancing legalization through the budget ahead of an April 1 deadline would not be achievable. In a new statement to Marijuana Moment, she said the legislature and governor “are deeply engaged in ensuring we quickly pass a budget that meets the immediate needs of our state as we face this crisis,” but cannabis reform may not make the cut. “Assembly [Majority Leader] Peoples-Stokes and I have put forward what I believe to be the best proposal to achieve marijuana legalization, and I would be happy to see...

Nebraska Medical Marijuana Campaign Suspended Due To Coronavirus
(California, Cannabis, Colorado, Legalization, Medical Marijuana, Nebraska, New York, United States, Washington) Nebraska activists announced on Thursday that they are temporarily suspending signature gathering for a campaign to legalize medical marijuana in the state , citing concerns about the novel coronavirus. This is just the latest example of how the COVID-19 pandemic is impacting drug policy reform efforts across the country, with advocates ending traditional campaign activities and some requesting emergency action to allow for alternative means to put measures on state ballots this year. That said, Nebraskans for Medical Marijuana said they remain confident that the initiative will prevail nonetheless. “Thank you to all Nebraskans who have given their support so far to our effort to get voter approval of legalized medical cannabis on the ballot this fall,” the group said in a Facebook post. “Your signatures, along with overwhelming citizen support for the measure, is going to help make it a reality and bring relief to individuals and communities throughout our entire state.” However, the...

US Hemp Roundtable: Latest State Alerts
(CBD, Hemp, Law, Nebraska, Products, South Dakota, Tennessee, United States, Industrial Hemp) While State Capitols across the country are closing themselves to the public in response to the coronavirus crisis, much legislative work continues to go on behind closed doors. And even where legislatures have recessed, many will return with critic al legislation before them. That’s why we expect elected officials to continue reviewing emails — meaning that now is an obvious time to reach out to them about our issues of concerns. This week, we’re focusing on three states where important hemp bills need our continued focus and action. State Alert: Tennessee Thanks to an extremely effective grassroots network of activists, the Volunteer State has one of the strongest legal regimes for hemp and CBD in the country. SB 0279 would make it even stronger by specifying that industrial hemp and products derived from industrial hemp are not subject to scheduling as a controlled substance and are not subject to forfeiture or seizure. Cannabis is currently decriminalized for cultivation and personal use across the country, but specific laws in relation to consumption vary by autonomous community.
