We’ll continue to update as regulators announce new policies. So far, during the COVID-19 pandemic, cannabis sales are through the roof as consumers stock up in anticipation of supply chain disruption. But, despite this upswing, cannabis companies are bracing for impact. As Cannabis Wire reported this week, a dilemma has hit the nascent industry: to close or not to close? Already, Canopy Growth chose to close nearly two dozen shops in Canada, and we’re tracking how other companies are reacting. But what happens in the case of forced closures? Cannabis regulators will have to weigh tough decisions in the coming days as businesses, from gyms to bowling alleys to bars, are asked to close as part of broader efforts to contain the spread of the virus. (While Canadian consumers can legally order cannabis online, should closures occur, changes are taking place north of the border. On...

Missouri Cannabis Advocates Admit Defeat Cannabis Legalization has “No Practical Way” Of Succeeding In Time Of Covid -19
(Cannabis, Legalization, Missouri, United States) This time, activists in Missouri announced on Saturday that their effort to put a cannabis legalization measure on the ballot has “no practical way” of succeeding amid the pandemic. In recent weeks, the outbreak of COVID-19 has resulted in business closures and increased calls for social distancing in states across the country. That has made mass signature gathering for drug policy reform measures virtually impossible. “Unfortunately, while there is widespread support from Missourians to tax and regulate marijuana, there is currently no practical way during the COVID-19 outbreak to safely, publicly gather the 170,000 plus signatures needed over the remaining 6 weeks to put this on the Missouri ballot in 2020,” John Payne, campaign manager for Missourians for a New Approach, said. The 2018 Farm Bill gives the US Department of Agriculture (USDA) regulatory authority over hemp cultivation at the federal level. In turn, states have the option to maintain primary regulatory authority over the crop cultivated within their borders by submitting a plan to the USDA. This federal and state interplay has resulted in many legislative and regulatory changes at the state level. Indeed, most states have introduced (and adopted) bills that would authorize the commercial production of hemp within their borders. Greenway – Article: Income Taxes and the Cannabis Business: The Impact of §280E
(Cannabis, Cleaning, Colorado, Consulting, Distribution, Extraction, Facilities, Fertilizer, GDGI, Grower, Law, Management, Manufacturing, Missouri, Packaging, Pesticide, Production, Products, Quality Control, Recreational, Software, Testing, United States, THC, Dispensaries, Cultivation, Real Estate, Security) Nondeductible Expenses Under Sec. 280E In 1982, Congress enacted Sec. 280E, which reversed a Tax Court decision (Edmondson, T.C. Memo. 1981-623) that had allowed deductions incurred in carrying on the production, distribution, and sale of controlled substances. Sec. 280E reads: No deduction or credit shall be allowed for any amount paid or incurred during the taxable year in carrying on any trade or business if such trade or business (or the activities which comprise such trade or business) consists of the trafficking in controlled substances (within the meaning of schedule I and II of the Controlled Substances Act) which is prohibited by Federal law or the law of any State in which such trade or business is conducted. In the context of marijuana, trafficking was defined by the Tax Court as the regular buying or selling of marijuana (Californians Helping to Alleviate Medical Problems (CHAMP), Inc., 128 T.C. 173 (2007)). The production or sale of marijuana is still illegal under U.S...

Kansas: Grand jury subpoena sought records of four Missouri medical marijuana applicants
(Cannabis, Consulting, Education, Kansas, Law, Medical Marijuana, Missouri, Production, Regulations, Science, United States, Real Estate) This sounds like an unravelling story of state politics and influence.. we shall keep an eye on this one. The Kansas City Star reports.…….A federal grand jury late last year demanded the Missouri Department of Health and Senior Services turn over all records pertaining to medical marijuana license applications of four individuals, according to a subpoena obtained by The Star. All four names were redacted by the department in The Star’s copy of the document. The first page of the subpoena requests that the department not publicly disclose the names because “it would be harmful to our investigation should these subjects be notified in any way of this request.” The subpoena was issued by the United States District Court for the Western District of Missouri in November 2019. The Star received a copy on Monday in response to a request under Missouri’s Sunshine Law. According to the subpoena, the department had until Jan. 7, 2020 to turn over to the grand jury any records in its possession...

The FBI Is Demanding That Missouri Turn Over Info on Medical Cannabis Applicants
(Biofuel, California, Cannabis, Growers, Kansas, Law, Medical Marijuana, Missouri, Production, United States, Dispensaries, Cultivation) Image via A federal grand jury is demanding that Missouri hand over all records associated with four people who submitted applications to run medical marijuana businesses last year. The subpoena, issued by the United States District Court for the Western District of Missouri last November, was recently discovered by the Kansas City Star , who obtained the information under the state's public records law. The names of the individuals being investigated were redacted in the Star's copy of the subpoena, however. The FBI has refused to discuss the matter further, which is standard practice for an ongoing investigation. In January, when this year's state legislative session convened, FBI agents began interviewing lawmakers, lobbyists, and staff. Most of these questions focused on Steve Tilley, a lobbyist who was once Speaker of the Missouri House, and is currently a close associate of Governor Mike Parson. Tilley reportedly has over a dozen clients in the medical marijuana industry,...
