COVID-19 a ‘net positive’ for marijuana producer Curaleaf, says analyst
(Cannabis, Investors, Massachusetts, Nevada, United States) 3/25/20–The COVID-19 pandemic has proven a boon to U.S. marijuana producer Curaleaf Holdings Inc. with roughly a 20% boost in sales, as sales jump and many states say that cannabis is an essential service. However, Curaleaf also rescinded its 2020 outlook as a result of the virus, telling investors Tuesday that its stores were closed in Massachusetts for the time being and will likely experience a falloff in sales in Nevada because of decreased tourism. Activists Protest Massachusetts' Decision to Close Adult-Use Cannabis Stores
(Alcohol, Cannabis, Growing, Massachusetts, Medical Marijuana, Netherlands, Recreational, United States, Dispensaries) The US is deep in the midst of the coronavirus pandemic , and a growing number of states have issued “shelter-in-place” orders, requiring all non-essential businesses to close. Most states have designated both adult-use and medical marijuana as essential services during the quarantine, but Massachusetts has taken a different stance on the matter. On Monday, Governor Charlie Baker announced that all non-essential businesses in the state would be forced to close until April 7 in order to minimize the spread of the virus. Baker declared that medical marijuana dispensaries and liquor stores are considered essential services, and will therefore remain open, but recreational weed businesses are considered non-essential. “The main reason is because Massachusetts is one of the big states with [a large] geographic area that has recreational marijuana, and there's a ton of traffic coming from that is coming from other states," said the governor, according to the Boston Business Journal . "We...

Most Americans Want Medical Cannabis Dispensaries to Stay Open During Lockdown
(Alcohol, Arizona, California, Cannabis, Colorado, Connecticut, Delaware, Florida, Hawaii, Illinois, Legalization, Louisiana, Maine, Maryland, Massachusetts, Medical Marijuana, Mexico, Michigan, Nebraska, Nevada, New Jersey, New Mexico, New York, Ohio, Oregon, Pennsylvania, Rhode Island, United States, Washington, Dispensaries) Most Americans believe that states should not restrict access to legal medical cannabis during “shelter-in-place” measures, according to a new poll . The poll , conducted by YouGov earlier this week, asked nearly 5,400 Americans whether medical marijuana dispensaries should be considered “essential services” or not. Slightly over half (53 percent) of all respondents agreed that access to medical marijuana was essential, and only 26 percent said that dispensaries should not be considered essential. A further 21 percent were undecided on the matter. As is often the case with cannabis-related polls , younger and more liberal respondents were more likely to be in favor of keeping dispensaries open. Between 54 and 59 percent of respondents between the ages of 18 and 54 agreed that medical marijuana is an essential service, but only 47 percent of those over 55 felt the same way. Democrats were also more likely (62 percent) to agree than independents (52 percent) or Republicans (43 percent...

Green Market Report’s Marijuana Money March 27, 2020
(Canada, Cannabis, CBD, Connecticut, Food, GGBXF, Green Growth, HRVSF, Massachusetts, Medical Marijuana, OGRMF, OrganiGram Inc, Recreational, United States, Dispensaries) The COVID19 pandemic continues to rage on. Unfortunately for Massachusetts recreational dispensaries, what had been the silver lining in the clouds, meaning increased sales, has been taken away. The state decided to stop all adult use cannabis sales and now only medical marijuana sales can take place. Despite the virus crisis, companies are still making key decisions. The Harvest Health and Verano deal is over. The deal which was once valued at $850 million when Harvest stock was trading at roughly $8 has been terminated. Harvest stock is now trading just over a dollar. Charlotte’s Web announced an agreement to acquire Abacus and the combined entity is anticipated to represent nearly 35% of U.S. CBD sales withing the Food/Drug/Mass Retail channel. The deal is valued at $99 million. Curaleaf Holdings, Inc. said it will acquire three Arrow Alternative Care (AAC) dispensaries in the state of Connecticut. AAC operates three out of 18 total stores currently operational in the state...

We’ll continue to update as regulators announce new policies. So far, during the COVID-19 pandemic, cannabis sales are through the roof as consumers stock up in anticipation of supply chain disruption. But, despite this upswing, cannabis companies are bracing for impact. As Cannabis Wire reported this week, a dilemma has hit the nascent industry: to close or not to close? Already, Canopy Growth chose to close nearly two dozen shops in Canada, and we’re tracking how other companies are reacting. But what happens in the case of forced closures? Cannabis regulators will have to weigh tough decisions in the coming days as businesses, from gyms to bowling alleys to bars, are asked to close as part of broader efforts to contain the spread of the virus. (While Canadian consumers can legally order cannabis online, should closures occur, changes are taking place north of the border. On...

Massachusetts Reinforces Support for the Medical Necessity Model
(California, Cannabis, Cannabis and Hemp, Development, Education, Facilities, GSML, Hemp, Hemp Industries, Illinois, Law, Management, Massachusetts, Medical Marijuana, Michigan, New York, Recreational, Regulations, Science, Testing, United States, Washington, Dispensaries, Cultivation, Intellectual Property) As more and more states are shifting to a work-from-home environment and closing down non-essential businesses, we have seen a conflict in gubernatorial instructions on whether cannabis is a protected class of business that falls under “essential infrastructure” or “essential business.” Earlier this week, we compared the approach New York and California have taken to permitting businesses to continue to operate. The former, medical-only state received a carte blanche endorsement as an essential business in New York to provide (often immunocompromised) patients with necessary medication. California, on the other hand, remained silent in executive orders, and left it up to local mayoral representatives to make determinations as they saw fit and best for their respective communities. Massachusetts has taken a middle road, as Governor Charles D. Baker issued COVID-19 Order No. 13 on March 23, 2020 which becomes effective March 24, 2020 at noon. This order identified an extensive list of “...

Americans Want Medical Marijuana Dispensaries To Stay Open As ‘Essential Services,’ Poll Finds
(California, Cannabis, Colorado, Illinois, Maryland, Massachusetts, Medical Marijuana, Nebraska, New Jersey, New York, Oregon, Products, Recreational, South Dakota, United States, Washington, Dispensaries) A majority of Americans believe that medical cannabis dispensaries should be kept open as “essential services” amid the coronavirus pandemic, according to a new poll. The survey asked simply: “Do you believe medical marijuana dispensaries should or should not be considered essential services?” Fifty-three percent said the cannabis providers should be regarded as essential, 26 percent said they shouldn’t and 21 percent said they didn’t know. YouGov. As state governments across the country grapple with the COVID-19 outbreak, officials have had to make difficult decisions about which businesses are critical enough to remain open and which should be forced to temporarily shut down. In many states with legal cannabis—including California, Colorado, Illinois, Maryland, Massachusetts and New Jersey—officials have determined that medical marijuana dispensaries are, in fact, essential services that can continue to operate. Many states have also given the “essential” designation to recreational...

Massachusetts Pot Shops Are Now Producing Hand Sanitizer for Local Hospitals
(Cannabis, Facilities, Management, Massachusetts, Medical Marijuana, Production, United States, Dispensaries) Like grocery stores, corner stores, and hospitals around the world, Massachusetts is running dangerously low on hand sanitizer. And with the spread of COVID-19 necistating extreme cleanliness, the Bay State’s licensed cannabis dispensaries are stepping up to help fill the void . According to MassLive , the Commonwealth Dispensary Association (CDA), a 36-member, 60-city strong cannabis trade organization, received approval from Governor Charlie Barker to divert at least some manpower to the production to hand sanitizer. In Massachusetts, medical cannabis dispensaries have been deemed “essential services” amidst the coronavirus crisis in the same vein as pharmacies. “Knowing that in States of Emergencies pharmacies can produce hand sanitizer and that we have equivalent lab facilities and knowledgeable personnel, I put forth the recommendation and was thrilled to see enthusiasm from other members,” John Hillier, a CDA board member, the executive director of Central Ave Compassionate Care...

Cannabis Companies Are Good Corporate Citizens
(Cannabis, Facilities, Management, Massachusetts, United States) This is the best story about the cannabis sector we’ve seen all week. Acting as good corporate partners to government and in turn helping their communities. This was all the talk of regulated cannabis back in 2015/16. It’s taken a pandemic to turn talk into action and let’s hope that each of these companies is smart enough to incorporate this thinking into their businesses as they hopefully grow in the future. Congratulations to all these companies Ganjapreneur reports….. Cannabis companies around North America are stepping up to help however they can in the fight against the spreading coronavirus. Massachusetts’ Commonwealth Dispensary Association is partnering with the Massachusetts Health & Hospital Association to make hand sanitizer and other cannabis companies around the continent are donating personal protection equipment to hospitals amid the coronavirus pandemic. Insurance Tips for Cannabis Businesses in Times of Crisis
(Cannabis, Events, Law, Management, Management Teams, Massachusetts, Medical Marijuana, United States) With crisis comes the need for insurance coverage. It’s not top of mind right now, nor should anyone expect it to be, but business models and short-term outlooks are changing dramatically each day, and now may be a good moment to ensure that management teams are prepared. Mike Sampson, partner in Reed Smith’s Insurance Recovery Group and co-vice chair of its Cannabis Law Team, says that business owners would do well to familiarize themselves with their insurance policies before the time comes to file a claim on some unexpected hardship. There are several types of coverage that are in play now, as the coronavirus outbreak continues to spread across the globe and force incredible economic pressure onto small businesses. Business interruption coverage is often a component of a company’s property insurance policy. For example, a standard policy might cover damage to a building or to personal property within. That policy may then include additional lines of coverage for situations that...

Colorado Attorney Discusses ‘New Normal’ in Cannabis Industry
(Cannabis, Colorado, Compliance, Facilities, Law, Massachusetts, Media, New Jersey, New York, Regulations, Regulatory Compliance, Retail Stores, Social Media, United States, Websites, Dispensaries, Cultivation) Recent coronavirus response measures in Denver and Colorado have been keeping attorney Alyson Jaen’s attention lately as the industry works to maintain compliance. At 5 p.m. MDT on March 24, Denver’s stay-at-home order went into effect in response to the coronavirus. The previous day, Mayor Michael Hancock said adult-use businesses and liquor stores are nonessential, but reversed course a few hours later after an “outcry” and let the businesses remain open, according to The New York Times .Facing orders to stay in their homes and the possibility of not being able to purchase product when they do leave their homes, demand among adult-use customers increased 140% on March 23 before the mayor said adult-use businesses are essential, said Jaen, who is head of Denver-based Fortis Law Partners’ cannabis practice.“It was in a matter of hours [that] we had a huge pivot—'Yes, you're open,' 'No, you're not.’” she said. “That creates confusion and this idea of panic-buying.”Previously, on March...

Top Marijuana Reform Group Wants Help Holding Lawmakers Accountable On Legalization
(California, Cannabis, Legalization, Massachusetts, United States) The national marijuana advocacy group NORML is launching a revamped online tool to help voters figure out where their representatives stand on cannabis policy. And they’re inviting people to help contribute to the comprehensive database. In an email to supporters on Tuesday, the organization said that while it recognizes the challenges presented by the coronavirus outbreak, voters must not lose track of the November elections. That’s because consequential cannabis reform issues are set to appear on ballots across the country and it remains important to hold lawmakers accountable for their positions on marijuana policy. To that end, NORML’s “Smoke the Vote” tool —a guide showing how federal and state officials have voted on reform issues and documenting their comments on the issue—is designed to help voters make informed decisions when they arrive at their polling places. Despite the ongoing crisis, the November elections will still hold major implications for the future of...

But the shutdowns have prompted perhaps an unexpected question amid the coronavirus chaos: Are medical marijuana operations considered “essential” in this new public arena? For many areas across the U.S., the answer is a resounding “yes.”Over in San Francisco, though, that wasn’t always the case. All seven counties in the Bay Area of California implemented a shelter-in-place order March 16. The order, which is in place until at least April 7, included a list of essential services that could remain open but left room for interpretation regarding other businesses, including...

Some entities, like police departments and pharmacies, are obvious in their need to remain open. But the shutdowns have prompted perhaps an unexpected question amid the coronavirus chaos: Are medical marijuana operations considered “essential” in this new public arena? For many areas across the U.S., the answer is a resounding “yes.” Over in San Francisco, though, that wasn’t always the case. All seven counties in the Bay Area of California implemented a shelter-in-place order March 16. The order, which is in place until at least April 7, included a list of essential services that could remain open but left room for interpretation regarding other...

The 2018 Farm Bill gives the US Department of Agriculture (USDA) regulatory authority over hemp cultivation at the federal level. In turn, states have the option to maintain primary regulatory authority over the crop cultivated within their borders by submitting a plan to the USDA. This federal and state interplay has resulted in many legislative and regulatory changes at the state level. Indeed, most states have introduced (and adopted) bills that would authorize the commercial production of hemp within their borders. A smaller but growing number of states also regulate the sale of products derived from hemp. In light of these legislative changes, we are presenting a 50-state series analyzing how each jurisdiction treats hemp-...

(Cannabis, Compliance, Law, Massachusetts, Products, United States, Security) Kevin Thorn writes…..Do you own a cannabis business in Massachusetts ? A well-versed Boston tax attorney explains what you need to know about the tax laws related to cannabis. 1. Massachusetts Imposes Sales and Excise Taxes on Cannabis Products At the state level in Massachusetts, there are two taxes that apply to the sale of cannabis products. These are: (i) the state sales tax of 6.25 percent; and, (ii) an additional state “excise” tax of 10.75 percent. Cannabis businesses must collect both of these taxes at the time of sale, and they must timely remit these taxes to the Massachusetts Department of Revenue (DOR) . 2. Local Sales Taxes Can Be Up to Three Percent Depending on where exactly your cannabis business is located, you may have to collect and remit a local sales tax as well. Local sales tax rates vary by jurisdiction, and can be as high as three percent of the retail price of goods sold. 3. You Do Have to Pay Federal Income Tax on Cannabis Sales Even though marijuana is still...
