AZ Cannabis Initiative Backers Are Trying to (Legally) Gather Signatures Online
(Arizona, Cannabis, United States) By Associated Press (AP) — Backers of four voter initiatives are asking the Arizona Supreme Court to let them gather qualifying signatures online now that the state is under a stay at home order and other restrictions because of the coronoavirus outbreak. The proponents asked the high court Thursday to allow them to use the same electronic system that candidates for state and federal offices now use to gather signatures. They say there’s no other safe and effective way for them to get their proposals on the ballot. They argue that the requirement for just initiative backers to collect signatures in person violates the state constitution. That’s because the ability of voters to write their own laws through the initiative process is a fundamental right under the constitution and the current emergency prevents them from doing that. They face a July 2 deadline to collect nearly 238,000 valid signatures from registered voters. “The campaign has over 300,000 signatures which is well over...

U.S. Discovers Major Cross-Border Drug Smuggling Tunnel
(Arizona, California, Cannabis, Lighting, Mexico, United States, Soil, Security) By Elliot Spagat, Associated Press (AP) — A large haul of drugs, including opioids, methamphetamine and cocaine, being smuggled from Mexico to California was seized from a cross-border tunnel equipped with ventilation, lighting and an underground rail system, authorities said Tuesday. The tunnel connected warehouses in Tijuana and San Diego, extending about 2,000 feet (610 meters) with an average depth of 31 feet (9.5 meters) and width of 3 feet (0.9 meter), according to the San Diego Tunnel Task Force, an investigative team made up of several federal agencies. Investigators believe the tunnel existed for several months “due to the advanced construction observed in several portions.” Authorities seized more than two tons of a variety of drugs, a departure from earlier discoveries that consisted largely of marijuana. The discovery of the tunnel on March 19 netted about 1,300 pounds (590 kilograms) of cocaine, 86 pounds (39 kilograms) of methamphetamine, 17 pounds (7.7 kilograms) of...

Idaho Activists Suspend Campaign To Legalize Medical Marijuana Due To Coronavirus
(Arizona, California, Cannabis, Events, Idaho, Legalization, Medical Marijuana, Mississippi, Missouri, Nebraska, New York, Oregon, Recreational, South Dakota, United States, Washington, THC) A campaign to put a medical marijuana initiative on Idaho’s November ballot announced on Thursday that it is suspending its signature collection efforts due to the coronavirus pandemic. It’s the latest in a series of drug policy reform campaign cancellations in recent weeks. Activists across the country have been left virtually helpless to qualify measures as governments continue to impose restrictions on public gatherings, encourage social distancing and issue shelter-in-place orders amid the COVID-19 outbreak. The Idaho Cannabis Coalition said that volunteers will no longer be conducting in-person signature gathering, and that will likely leave the campaign without enough signatures to make the ballot. They had to collect 55,057 by May 1 to qualify. Additionally, the state requires that initiatives receive signatures from six percent of registered voters from a majority of legislative districts. What that means is “the odds are against Idahoans being able to vote on medical...

53% of Americans Agree That Dispensaries Are “Essential” Amid Virus
(Arizona, Cannabis, Medical Marijuana, Recreational, United States, Dispensaries) According to a new survey by YouGov, a majority of Americans believe that medical marijuana dispensaries should be deemed “essential services” and therefore remain open during the current “stay-at-home” lockdowns due to the coronavirus (COVID-19) pandemic. “Most Americans (53%) believe medical marijuana dispensaries should be considered essential services,” YouGov said. The survey data also found that 26% of people believe medical marijuana dispensaries “should not be considered essential services” while 21% said they “don’t know.” Many states have imposed stay-at-home orders on their residents to slow the spread of coronavirus. Fortunately, thus far, every state has deemed medical marijuana dispensaries essential because they provide medicine to people. Some states have even deemed recreational dispensaries essential because cannabis can help people cope with anxiety and depression. “Democrats (62%) are more likely than Independents (52%) and Republicans (43%) to say this.” The post...

Cannabis Municipal Bonds Could Be The Future
(Alcohol, Arizona, Banking, Cannabis, Colorado, Connecticut, Consulting, Development, Education, Exploring, Growing, Investments, Investors, Iowa, Legalization, Minnesota, Missouri, Montana, New Jersey, New York, Products, Regulations, Tobacco, United States, Vermont) MPG Consulting has recently authored a report looking at the potential of Cannabis Municipal Bonds (CMB). Adam Orens, Founder of MPG and Sal Barnes, Managing Director, MPG have conducted a theoretical analysis using Colorado showing how the state can translate its cannabis revenue into a short-term bond amount of $166 million and long-term bond issued in the amount of $591 million resulting in $123 million and $438 million available for educational initiatives and infrastructure, respectively. States and municipalities already use revenue bonds as a way to pay for large projects. The investors of such bonds feel that the risk for these investments is lower since there is a captive source of revenue to pay the interest. The report gives Iowa as an example. That state allocates $55 million in gaming taxes every year to pay the debt on revenue bonds that were issued in 2009 and 2010. That money raised selling these bonds was then used for community revitalization, flood mitigation, and...

Arizona Issues “Stay-At-Home” Order Starting March 31 to Fight Coronavirus
(Arizona, Biotechnology, Cannabis, Cleaning, Distribution, Education, Facilities, Food, Management, Media, Medical Marijuana, Production, Products, Research, United States, Dispensaries, Real Estate, Security) Numerous states throughout the U.S. have been put on “stay-at-home” orders restricting residents to their homes except for when traveling to or from “essential” businesses. Arizona has now joined those states with a mandatory stay-at-home order that is effective from March 31 at 5pm until April 30, ABC 15 reported. And it’s possible that Governor Ducey could extend the lockdown past April 30. Ducey said the “Stay Home, Stay Healthy, Stay Connected” order was created to promote “physical distancing, while also encouraging social connectedness.” Fortunately, Arizona medical marijuana dispensaries have been deemed essential by the state because they provide medicine, which is essential to Arizonans. Many dispensaries have implemented safety precautions to prevent the spread of coronavirus (COVID-19). For example, most offer online ordering, pick-up and/or delivery services, are using personal protective equipment, restrict the amount of patients allowed inside, and frequently disinfect...

Home Values Increase in Neighborhoods with Marijuana Dispensaries
(Arizona, Cannabis, Colorado, Legalization, Oklahoma, Products, Recreational, Research, United States, Washington, Dispensaries, Recreational Cannabis) According to research by a team of economists from University of Oklahoma, the passing of marijuana sales by states is associated with home values increasing. The researchers stated that their “results suggest that preferences for public services – derived from a new source of tax revenue – and dispensaries as a commercial amenity create largely positive effects following the legalization of recreational marijuana,” NORML reported. In Colorado and Washington, the researchers determined that houses in neighborhoods with new dispensary openings nearby saw 7% price appreciation. They assessed the relationship between regional home values and state-specific cannabis legalization and found “a large positive spillover effect on the housing market following legalization.” In particular, “a five percent appreciation in home prices following the passage of RML (recreational marijuana laws) and an 11 percent appreciation once sales of marijuana products begin.” Other studies over the last...

Marijuana Legalization ‘Not Likely’ In New York Budget, Governor Says On Eve Of Deadline
(Arizona, California, Cannabis, Connecticut, Events, Legalization, Medical Marijuana, Missouri, Nebraska, New Jersey, New York, Oregon, Regulations, United States, Washington) Marijuana legalization is “not likely” to be included in the final budget in New York, Gov. Andrew Cuomo (D) said on Tuesday, explaining that the issue proved too complicated as the state grapples with the coronavirus. Another sign that the policy change isn’t happening as Cuomo and advocates had planned comes from a pair of newly revised budget bills that exclude the proposal, making it all but certain that legalization won’t make the final cut. “Too much, too little time,” the governor said of the proposal during a press conference. Watch Cuomo’s cannabis comments in the video below: Later in the day, Cuomo expanded on why legal cannabis likely would be left out of the budget in a radio interview. “We’re not going to get there. I don’t believe we get there because in truth that is something that had to be talked through and worked through, and the legislature wasn’t here. I was doing this COVID virus,” he told WAMC’s Alan Chartock. “That requires time to do it right.” “That is not a...

Arizona MJ Activists Have More Than Enough Signatures To Put Legalization On Ballot, They Say
(Arizona, Cannabis, Legalization, Stocks, United States) Arizona MJ Activists Have More Than Enough Signatures To Put Legalization On Ballot, They Say At a time when drug policy reform campaigns across the country are suspending efforts amid the coronavirus pandemic, marijuana activists in Arizona say they’ve already collected more than enough signatures to qualify a legalization measure for the state’s November ballot. The Smart and Safe Arizona campaign to legalize cannabis for adult use said it has gathered more than 320,000 signatures—about 80,000 more than is required to make the ballot. “We’re confident that we’re over the number that we need,” Campaign Manager Stacy Pearson told Marijuana Moment in a phone interview on Thursday, adding that while the state only verifies signatures after they’re submitted, internal validation by the campaign signals that they’re well ahead of where they need to be to qualify the measure. In the meantime, the campaign is putting a pause on further signature collection, citing concerns about the COVID-...

DC Activists Have A New Plan To Get Psychedelics Decriminalization On The Ballot Despite Coronavirus
(Arizona, California, Cannabis, Events, Exploring, Law, Legalization, Medical Marijuana, Missouri, Nebraska, New York, Oregon, United States, Washington) Activists in Washington, D.C. are considering a new strategy to get a measure to decriminalize psychedelics on the November ballot, with the coronavirus outbreak having forced them to suspend in-person signature gathering . While Decriminalize Nature D.C. hoped that officials would pass emergency legislation allowing the digital collection of signatures , they aren’t actively considering that option. And the District Council’s chairman said he would not simply place the initiative on the ballot for voters to decide regardless of the signature count. That’s left the group in a challenging position. But they’re not out of ideas yet. Now the campaign is exploring the possibility of conducting “micro-scale petition signature collection” to make the ballot. The plan would involve having petitions mailed to supporters, who would circulate it and collect signatures from “registered DC voters in their immediate vicinity, such as family, roommates, friends and close-by neighbors” and then...

Marijuana Legalization Left Out Of New York Budget, According To Draft Summary Document
(Arizona, California, Cannabis, Events, Extraction, Growers, Legalization, Management, Medical Marijuana, Missouri, Nebraska, New York, Oregon, United States, Washington, Cultivation, Funding) The New York legislature seems poised to eliminate a proposal to legalize marijuana through the budget this year, according to an unverified document outlining the policies included in the spending legislation currently under final negotiations ahead of a vote this week. The draft budget report, which was shared with Marijuana Moment, includes a line stating that the “Adopted Budget omits the Executive proposal to legalize adult use cannabis.” It also “eliminates $34.31 million in funding for the Office for Cannabis Management,” a government body that would have been responsible for regulating the marijuana market. The apparent exclusion of Gov. Andrew Cuomo’s (D) legalization proposal, while disappointing to reform advocates, is not entirely surprising in the context of the coronavirus outbreak. While the governor repeatedly stressed that the policy change should be enacted through the budget , he and top lawmakers have tried to temper expectations in recent weeks as legislative...

Doctor Sues the DEA Over a “Secret Law" Blocking Cannabis Research
(Arizona, Cannabis, Facilities, Grower, Growers, Growing, Law, Manufacture, Medical Marijuana, Mississippi, Research, Texas, United States, Cultivation) Attorneys filed suit last week against the Drug Enforcement Administration (DEA) and the Department of Justice (DOJ) over an alleged “secret law” that has stalled legitimate medical marijuana research in the US for the past three years. The lawsuit, dated March 25, came from Yetter Coleman, LLP , a Texas-based law firm that represents the Scottsdale Research Institute (SRI). Based in Arizona, SRI is led by Dr. Sue Sisley, a licensed physician who has been investigating medical marijuana as a treatment for cancer and PTSD. Last year, she filed suit against the DEA after the agency failed to review her application for a third-party marijuana growing license under the Obama-era Growers Program. According to the complaint, under the Trump administration, the Department of Justice’s Office of Legal Counsel (OLC) issued its own interpretation of the UN Single Convention treaty and the US Controlled Substances Act that required the DEA to draft new rules for the Growers Program. The proposed...

New Mexico Now Has More Cannabis Patients Than Colorado
(Arizona, Cannabis, Colorado, Medical Marijuana, Mexico, New Mexico, Research, United States, Dispensaries) New Mexico’s medical cannabis program patient enrollment has surpassed Colorado’s patient enrollment for the first time since its inception. According to data from the New Mexico Department of Health (NMDOH), the state has 82,147 medical marijuana patients while Colorado has 81,893, Ultra Health reported. Since Colorado legalized adult-use marijuana in 2014, the state’s medical marijuana program has declined from nearly 115,000 patients to less than 82,000. During the same time period, New Mexico’s medical cannabis patient enrollment increased 667% from 10,708 to over 82,000. In contrast, Arizona’s medical marijuana program has approximately 230,000 patients . A recent NMDOH patient survey performed by Research & Polling Inc. found there is a shortage of marijuana available for patients. In the survey, 55% of New Mexico’s dispensaries said they’re unable to keep pace with the demand for medical marijuana. Furthermore, one in four patients in New Mexico claim they were unable to...

The 2018 Farm Bill gives the US Department of Agriculture (USDA) regulatory authority over hemp cultivation at the federal level. In turn, states have the option to maintain primary regulatory authority over the crop cultivated within their borders by submitting a plan to the USDA. This federal and state interplay has resulted in many legislative and regulatory changes at the state level. Indeed, most states have introduced (and adopted) bills that would authorize the commercial production of hemp within their borders. A smaller but growing number of states also regulate the sale of products derived from hemp. In light of these legislative changes, we are presenting a 50-state series analyzing how each jurisdiction treats hemp-...

Virus Not Stopping Nebraska Medical Marijuana Ballot Initiative
(Arizona, Cannabis, Events, Law, Medical Marijuana, Nebraska, United States) By Grant Schulte, Associated Press (AP) — Nebraska voters may still get a chance to legalize medical marijuana and casino gambling even though the new coronavirus (COVID-19) has forced activists to stop collecting signatures to place the issues on the November ballot. Organizers from both campaigns said they’re confident they’ll have enough signatures to qualify before the July 2 deadline to submit their petitions, even though they’ve pulled their circulators off the streets. Both groups said they had already gathered a large number before the pandemic forced the closure of public buildings and cancellation of major events where circulators often work. “I’m still optimistic,” said Sen. Anna Wishart, a co-chairwoman of Nebraskans for Medical Marijuana. “It’s a popular issue, and we’ve got a really good base of signatures. I feel really positive about where we are right now.” Because the measures are proposed constitutional amendments, the petition campaigns need signatures from at...

Missouri Marijuana Legalization Campaign In Jeopardy Due To Coronavirus
(Arizona, California, Cannabis, Events, Exploring, Law, Legalization, Medical Marijuana, Missouri, Nebraska, Oregon, United States, Washington) Coronavirus has dealt another blow to the marijuana reform movement. This time, activists in Missouri announced on Saturday that their effort to put a cannabis legalization measure on the ballot has “no practical way” of succeeding amid the pandemic. In recent weeks, the outbreak of COVID-19 has resulted in business closures and increased calls for social distancing in states across the country. That has made mass signature gathering for drug policy reform measures virtually impossible. “Unfortunately, while there is widespread support from Missourians to tax and regulate marijuana, there is currently no practical way during the COVID-19 outbreak to safely, publicly gather the 170,000 plus signatures needed over the remaining 6 weeks to put this on the Missouri ballot in 2020,” John Payne, campaign manager for Missourians for a New Approach, said. He added that the group is still “exploring our options at this point” but if it ultimately cannot find a path to the ballot for this...

12 Groups Are Pushing Senate Committee to Pass Marijuana Banking Bill
(Arizona, Banking, Cannabis, CBD, Hemp, Law, Products, United States) Over a dozen cannabis industry and advocacy trade organizations have sent a letter to the Senate Banking Committee Chairman Mike Crapo requesting that he act speedily to advance the SAFE Banking Act, which would create a safe harbor for banking institutions trying to serve legal cannabis-related businesses in states where such activity is legalized. Last year, the SAFE Banking Act was passed by a bipartisan majority in the House but has stalled in the Senate after Rep. Crapo voiced concerns about the bill leading to money laundering, American Bankers Association (ABA) reported . “Our organizations continue to support SAFE because it is an initial legislative step that allows the legal cannabis industry into the banking system – ultimately protecting law-abiding financial institutions and ancillary services businesses from their untenable position and addressing increasing public safety concerns,” part of the ABA’s letter reads. “Additionally, the ongoing lack of a safe harbor for...

Scientists Sue DEA Over Alleged ‘Secret’ Document That Delayed Marijuana Research Expansion
(Arizona, Cannabis, Compliance, Distribution, Facilities, Growers, Hemp, Law, Manufacture, Manufacturing, Medical Marijuana, Mississippi, Processing, Products, Research, United States, Cultivation) The Drug Enforcement Administration (DEA) is finding itself in court over marijuana again after scientists filed a lawsuit against the agency, requesting “secret” documents that they allege DEA used to delay action on expanding cannabis research. The Scottsdale Research Institute (SRI) is behind the suit. It’s one of more than 30 organizations that have submitted applications to DEA to become licensed cannabis manufacturers for research purposes. Some background should be noted: In 2016, DEA announced it would expand marijuana research by approving additional growers beyond the sole source that has existed for half a century at the University of Mississippi. But after more than three years, applicants heard silence , and SRI filed an initial lawsuit alleging that the agency was deliberately holding up the process . A court mandated that it take steps to make good on its promise, and that case was dropped after DEA provided a status update . This month, DEA finally unveiled a revised...

Most Americans Want Medical Cannabis Dispensaries to Stay Open During Lockdown
(Alcohol, Arizona, California, Cannabis, Colorado, Connecticut, Delaware, Florida, Hawaii, Illinois, Legalization, Louisiana, Maine, Maryland, Massachusetts, Medical Marijuana, Mexico, Michigan, Nebraska, Nevada, New Jersey, New Mexico, New York, Ohio, Oregon, Pennsylvania, Rhode Island, United States, Washington, Dispensaries) Most Americans believe that states should not restrict access to legal medical cannabis during “shelter-in-place” measures, according to a new poll . The poll , conducted by YouGov earlier this week, asked nearly 5,400 Americans whether medical marijuana dispensaries should be considered “essential services” or not. Slightly over half (53 percent) of all respondents agreed that access to medical marijuana was essential, and only 26 percent said that dispensaries should not be considered essential. A further 21 percent were undecided on the matter. As is often the case with cannabis-related polls , younger and more liberal respondents were more likely to be in favor of keeping dispensaries open. Between 54 and 59 percent of respondents between the ages of 18 and 54 agreed that medical marijuana is an essential service, but only 47 percent of those over 55 felt the same way. Democrats were also more likely (62 percent) to agree than independents (52 percent) or Republicans (43 percent...

First Legal Marijuana Home Deliveries Begin In Colorado
(Arizona, Cannabis, Colorado, Growing, Law, Legalization, Medical Marijuana, Products, Recreational, United States, Dispensaries, Recreational Cannabis) For the first time, people in Colorado will be able to legally have marijuana products delivered directly to their homes starting on Friday. The launch of the limited program focused on medical cannabis patients comes one week after the dispensary chain Native Roots announced that its Boulder location The Dandelion had received the state’s first marijuana delivery license . And while the license wasn’t related to the coronavirus outbreak, the timing is opportune, as officials have increasingly cautioned against leaving home to avoid catching or spreading the virus. The delivery service will be limited to patients living in either Boulder or Superior. They must also be registered with the dispensary, and those who are not already signed up must do so in-person for the time being—though Native Roots said it is “looking into a compliant, remote solution for patient registration.” Native Roots said there is a $100 minimum purchase, and they’re encouraging patients to pay with a debit card...

Dispensaries to Stay Open as Denver Undergoes ‘Stay at Home’ Order
(Arizona, California, Cannabis, Illinois, New York, Recreational, United States, Dispensaries) By Associated Press (AP) — Denver has issued a “stay at home” order limiting most people to going out only for essentials such as groceries, medication and exercise as officials try to slow the spread of the coronavirus (COVID-19). Under the order from Mayor Michael Hancock, businesses that are not considered “essential” must be closed until at least April 10. The closures initially included liquor stores and recreational marijuana shops, but Hancock later amended the order to allow those businesses to remain open as long “extreme physical distancing” is in place. Residents flocked to liquor stores and marijuana dispensaries and queued in long lines shortly after Hancock issued the initial order. States such as California, Illinois and New York have implemented “stay at home” orders to curb the coronavirus pandemic. These states have also deemed marijuana dispensaries as essential, thus allowing them to remain open along with other essential businesses such as pharmacies, banks, and...

AZ Marijuana Initiative Hits 300,000 Signatures, Surpassing Required Amount
(Arizona, Cannabis, Recreational, United States, Dispensaries, Cultivation) The Smart and Safe Arizona ballot initiative that could legalize marijuana for adults 21 years and older in Arizona has quickly gathered more than 300,000 signatures, well surpassing the 237,645 required to get listed on the ballots in November 2020. Due to the coronavirus pandemic, the campaign has suspended any further signature gathering efforts. “The campaign has over 300,000 signatures which is well over the required number,” Eric Chambers from the campaign told AZmarijuana.com. “For the health and safety of everyone, we have suspended signature gathering for the time being but are in good shape.” The campaign has to submit the signatures to the Arizona Secretary of State for approval before July. Most of the signature gathering was done in front of Arizona dispensaries and at various mega stores like Target and Wal-Mart where individual signature gatherers asked passersby if they’d like to sign and support the initiative. Key facts about the initiative: – legalizes marijuana...
