Scientists Sue DEA Over Alleged ‘Secret’ Document That Delayed Marijuana Research Expansion
(Arizona, Cannabis, Compliance, Distribution, Facilities, Growers, Hemp, Law, Manufacture, Manufacturing, Medical Marijuana, Mississippi, Processing, Products, Research, United States, Cultivation) The Drug Enforcement Administration (DEA) is finding itself in court over marijuana again after scientists filed a lawsuit against the agency, requesting “secret” documents that they allege DEA used to delay action on expanding cannabis research. The Scottsdale Research Institute (SRI) is behind the suit. It’s one of more than 30 organizations that have submitted applications to DEA to become licensed cannabis manufacturers for research purposes. Some background should be noted: In 2016, DEA announced it would expand marijuana research by approving additional growers beyond the sole source that has existed for half a century at the University of Mississippi. But after more than three years, applicants heard silence , and SRI filed an initial lawsuit alleging that the agency was deliberately holding up the process . A court mandated that it take steps to make good on its promise, and that case was dropped after DEA provided a status update . This month, DEA finally unveiled a revised...

Charlotte’s Web Reports $18.8M Q4 Loss, Executives Discuss Challenges and the Future
(Acquisition, Banking, CBD, Development, Distribution, Food, Growing, Hemp, Products, Regulations, Research, Topicals, Vertically Integrated, Cultivation) Despite it being the first full year that hemp cultivation was legal in the U.S., 2019 was a tough year for many along the supply chain.Denver-based cannabidiol (CBD) giant Charlotte’s Web can attest to that, especially for the tail-end of the year. The company’s latest earnings report shows it lost $18.8 million in Q4 of 2019, a steep tumble from the $3.2 million in net income it earned in the same period the year prior. The story for the full year includes another substantial fall. The company reports a loss of $15.6 million for all of 2019, compared with $11.8 million net income in 2018—a 232% decrease from the year prior. During a recent earnings call, CEO Deanie Elsner attributed the Q4 loss to a slowdown of growth in the food/drug/mass (FDM) retail channels because of regulatory uncertainty, as well as an oversaturation of products in the market. In December of 2019, the U.S. Food and Drug Administration (FDA) issued several warning letters to CBD companies for violating labeling...

(Banking, Cannabis, Distribution, Growers, Law, Loans, Products, Cultivation, Funding) There is no doubt that the COVID-19 pandemic is adversely impacting businesses around the world, and smaller businesses especially. That is why this week, NORML reached out to our numerous allies on Capitol Hill to ensure that any Unemployment Insurance aid packages considered by Congress provide relief to cannabis-industry personnel who have been or will be either furloughed from their jobs. “Given the tremendous amount of uncertainty in the broader economy, the hundreds of thousands of American workers who are employed by the state-legal marijuana industry must be respected and protected by the emergency actions being taken by elected officials,” said NORML Political Director Justin Strekal. WHY THIS CLARIFICATION IS IMPORTANT According to a recent report by Leafy.com , the state-licensed cannabis industry employs more than 240,000 American workers. To put that total in context, the state-authorized cannabis marketplace employs over four times the number of American workers as does...

Cannabis Businesses Are Ineligible for Federal Coronavirus Relief
(Cannabis, Distribution, Growers, Hemp, Law, Loans, Products, United States, Washington, THC, Cultivation) The US Senate has just agreed on a 2 trillion dollar stimulus package to help boost the economy during the coronavirus quarantine, but as usual, state-legal cannabis businesses are being left out of the picture . On Monday, Greg Hubly, the owner of a small weed business in Washington State, asked the Small Business Association (SBA) whether cannabis companies would be eligible for federal relief packages. The Pacific NW chapter of the SBA responded that “with the exception of businesses that produce or sell hemp and hemp-derived products... marijuana-related businesses are not eligible for SBA-funded services.” Hubly was not surprised by the agency's response. Cannabis plants containing more than 0.3 percent THC are still classified as marijuana, a Schedule I drug , and federal law prohibits any business that handles a controlled substance from receiving any sort of federal aid. Hemp, on the other hand, was made federally legal by the 2018 Farm Bill , and hemp businesses are therefore...

(California, Cannabis, Distribution, Law, Oregon, Research, Training, United States, Washington, Cultivation) The nation’s first government panel focused on psychedelics policy reform held its second meeting on the implementation of a Denver decriminalization law on Tuesday, reaching an agreement on law enforcement reporting criteria for activity related to psilocybin mushrooms. It held its first meeting last month, with city officials, law enforcement and advocates deciding on largely technical matters related to the policy’s enactment . This time around, the group made a significant decision about various factors that should be included in reports about enforcement of psilocybin laws as the city tracks implementation of the measure. The meeting was initially set to be held in-person, but plans shifted amid the coronavirus pandemic and the...

Here Comes The Next Wave Of Cannabis Layoffs
(Cannabis, Distribution, Germany, Investments, Marketing, Media, Processing, Production) Struggling before the pandemic the sector had already started shedding jobs in production and processing. Now COVID-19 has sped up part 2 marketing and distribution realignment. Leafly has announced 91 jobs are to go. We also wonder when the conference / media parts of the sector will have to start accepting defeat ( of a sort ) Interestingly as this story illustrates the world of cannabis content and news has been very lively over the past few weeks because the journalists actually have time to write stories rather than rushing from conference to conference looking for the story. The issue, of course, is how long can these companies maintain their wage packets , weeks? months? We’re not going to see a cannabis conference again until September in the US at the earliest. How will these organisations keep their head above water until then? Reports are all well and good ,but if there’s a market with not many participating, we’d suggest that this is one expense companies will drop in the...

Governor’s Office Designates Cannabis an Essential Business
(California, Cannabis, Clothing, Distribution, Facilities, Food, Law, Manufacturing, Production, Products, Regulations, United States, Licensee, Cultivation) On Thursday, March 19, 2020, Governor Gavin Newsom issued a stay at home order to protect the health and well-being of all Californians and to establish a consistent approach across the state to slow the spread of COVID-19. This order went into effect on Thursday, March 19, 2020, and is in place until further notice. The order identifies certain services as essential, including food, prescriptions, and healthcare. These services can continue despite the stay at home order. Because cannabis is an essential medicine for many residents, the Governor clarified his order on March 22, 2020, by declaring that cannabis retailers are an essential business and workers supporting cannabis retail and dietary supplement retail are an essential worker force. In conjunction with the Governor’s declaration, the California Bureau of Cannabis Control (BCC), the California Department of Public Health (CDPH), and the CalCannabis Cultivation Licensing division of the California Department of Food and...

(California, Cannabis, Cannabis and Hemp, Compliance, Deals, Development, Distribution, Education, Facilities, Food, Hemp, Law, Manufacturing, Medical Marijuana, New York, Products, Recreational, Regulations, Science, United States, Dispensaries, Pharmaceuticals, Intellectual Property, Security) Across the country, state legislature and gubernatorial offices are taking a hard look at their state workforces, productivity measures, and the rapidly climbing statistics associated with the COVID-19 outbreak. Naturally, each respective state has different needs and protocols depending on its population distribution, prevalence of travel/interaction, and its infrastructure. However, certain tenets remain constant; critical infrastructure sectors must be preserved to permit citizens to retain a semblance of normal life during periods of quarantine. This begs the question, does the cannabis industry qualify as a critical component of a permissive state’s infrastructure? Here, we take a look at an East vs. West approach to maintaining the established Cannabis ecosystems in coastal states California and New York. California ProgressionOn March 4, 2020, California Governor Gavin Newsom proclaimed a State of Emergency in California as a result of the threat of COVID-19. As of March 19,...

Public Safety Canada: Announcement On Enforcement of Illegal Cannabis
(Canada, Cannabis, Distribution, Law, Legalization, Processing, Production, Recreational, Regulations, Research, Testing, Training, Dispensaries, Recreational Cannabis, Cultivation, Funding) Law Enforcement Related to Cannabis Background The Cannabis Act, which sets out the legal framework for controlling the production, distribution, sale and possession of cannabis across Canada, came into force on October 17, 2018. The two overarching objectives of the framework are to displace the illegal market and to keep cannabis out of the hands of youth. In advance of cannabis legalization, the impaired-driving regime in Canada’s Criminal Code was changed to include the addition of three new offences with regard to concentrations of drugs in the blood in excess of set limits within two hours of driving; corresponding penalties; and authorization for police to use approved oral fluid drug screeners. Public Safety (PS) is supporting efforts to enforce the legalization and regulation of cannabis through activities to deter criminal activity and to help ensure that organized crime does not penetrate the legalized system. PS is also leading the implementation of the new drug-impaired...

How are you getting your cannabis during lockdown? (Canada)
(Canada, Cannabis, Distribution, Investment, Online Store, Online Stores, Strains) It would be cool to have some community engagement and have a survey to determine how Redditors are getting their cannabis during crisis. Many LPs do their own delivery through their online stores in addition the government stores. I’ve heard through the business grapevine that the distribution centres in these stores are not up to par unless they’re using a third party like Pineapple Express. I’ve suggested using NamasteMD to teleconference with a nursing practitioner, get a prescription, order from cannmart, and get same day delivery. I’m personally surprised that at least 10 people I spoke with in the real world have gone that route. One said that supply was still an issue with some of the LPs and that they couldn’t get the strain they wanted but that wasn’t a common talking point. What are you guys doing? Are you going after the big names or maybe The medical ones with first time sign up promo codes? Interested in getting Particular strains? Are you only supporting your investment...

Hemp Company Atalo Holdings Files for Bankruptcy
(CBD, Consulting, Distribution, Genetics, Growers, Growing, Hemp, Kentucky, Processing, Production, Research, United States, Vertically Integrated, Industrial Hemp, Cultivation) Atalo is at least the third hemp company in Kentucky to file for bankruptcy this year. Another industrial hemp company has filed for bankruptcy at a time when the burgeoning industry is struggling to find its bearings in the face of numerous challenges. Atalo Holdings Inc., based in Winchester, Ky., has filed for Chapter 7 bankruptcy protection, mainly citing issues with capital. The company was one of the first hemp processing companies in Kentucky following the passage of the Agricultural Act of 2014 (the 2014 Farm Bill). The vertically integrated hemp research, production and processing company aimed to develop “reliable pathways to market for consistent hemp CBD [cannabidiol], superfood and fiber with emphasis on traceable, certified seed genetics, proven agronomics, and the mechanization of growing and harvesting,” it says on its website. “Hemp processors, along with our farmers and other partners, have essentially created an entirely new agricultural industry. (Cannabis, Cleaning, Colorado, Consulting, Distribution, Extraction, Facilities, Fertilizer, GDGI, Grower, Law, Management, Manufacturing, Missouri, Packaging, Pesticide, Production, Products, Quality Control, Recreational, Software, Testing, United States, THC, Dispensaries, Cultivation, Real Estate, Security) Nondeductible Expenses Under Sec. 280E In 1982, Congress enacted Sec. 280E, which reversed a Tax Court decision (Edmondson, T.C. Memo. 1981-623) that had allowed deductions incurred in carrying on the production, distribution, and sale of controlled substances. Sec. 280E reads: No deduction or credit shall be allowed for any amount paid or incurred during the taxable year in carrying on any trade or business if such trade or business (or the activities which comprise such trade or business) consists of the trafficking in controlled substances (within the meaning of schedule I and II of the Controlled Substances Act) which is prohibited by Federal law or the law of any State in which such trade or business is conducted. In the context of marijuana, trafficking was defined by the Tax Court as the regular buying or selling of marijuana (Californians Helping to Alleviate Medical Problems (CHAMP), Inc., 128 T.C. 173 (2007)). For Cannabis Distribution Companies, It Helps to Have a Nimble Business Model in Times of Crisis
(California, Cannabis, Distribution, Education, Events, Inventory Management, Management, United States, Dispensaries) SparqOne announced a March 17 distribution agreement with Kushy Punch, Church, Mindset Organics, Branded and Smoakland to reach more than 400 dispensaries across California. The move filled out SparqOne’s offerings in each cannabis product category, giving the company a more robust network to capitalize on its core promises: “superior customer service, next day delivery, and real time sales and inventory management.” General Manager Andrew Dorsett says that the propelling force here is communication between businesses along the supply chain. Distribution companies touch all corners of their network, and he says that SparqOne drivers prioritize the needs of dispensary owners with whom they’re working each day. They’re sharing news and constantly picking up feedback as to what’s selling, what’s not selling, what sort of questions patients and customers are asking at any given moment in this rapidly evolving industry.Of course, SparqOne’s recent agreement comes amidst the coronavirus...

DEA Is Moving Forward with Cannabis Grow Licensing to Expand Marijuana Research
(Cannabis, Development, Distribution, Facilities, Growers, Growing, Manufacturing, Mississippi, Processing, Product Development, Production, Regulations, Research, United States, Pharmaceuticals, Cultivation) As the rest of the country grinds to a halt to slow the spread of coronavirus, the US Drug Enforcement Agency (DEA) is actually advancing long-delayed plans to provide high-quality cannabis for research purposes. In a new Notice of Proposed Rulemaking to be published in the Federal Register next week, the DEA proposes to amend its regulations governing the production of federally-legal research-grade cannabis. "Specifically, this proposed rule would amend the provisions of the regulations governing applications by persons seeking to become registered with DEA to grow 'marihuana' as bulk manufacturers and add provisions related to the purchase and sale of this 'marihuana' by DEA," the notice reads, according to Forbes . The ongoing federal prohibition of cannabis has made it extremely difficult for scientists to conduct clinical research on marijuana. In order to provide researchers a legal source of weed, the DEA licensed the University of Mississippi to begin growing a small amount...

DEA Unveils New Rule To Finally Allow More Marijuana Growers For Research
(Cannabis, CCHWF, Columbia Care, Compliance, Development, Distribution, Facilities, Food, Growers, Hemp, Law, Manufacture, Manufacturer, Medical Marijuana, Mississippi, Product Development, Products, Regulations, Research, Stocks, Strains, United States, Wellness Center USA, THC, Dispensaries, Cultivation) The Drug Enforcement Administration (DEA) announced on Friday that it will be taking significant steps to expand marijuana research. The agency is proposing a rule change that would enable it to approve additional cannabis growers and diversify the types of marijuana available to be used in studies. The move comes more than three years after the agency initially said it was accepting applications for additional marijuana manufacturers . DEA stressed throughout the new notice that it will have sole ownership over any marijuana that’s cultivated for research purposes. That includes any cannabis that’s stored at cultivation facilities. This appears to be a fundamental change in policy. As it stands, a single facility in Mississippi is authorized to grow cannabis through a contract with the National Institute on Drug Abuse (NIDA), and DEA does not maintain ownership over its products. “The Drug Enforcement Administration continues to support additional research into marijuana and its...

In a letter to staff on Wednesday, State’s Attorney Marilyn Mosby listed a series of offenses that should not result in incarceration. Drug possession, attempted drug distribution, prostitution, traffic offenses and public urination are among the offenses that shouldn’t land people being bars at this point, according to Mosby’s guidance. Putting these individuals in jail could exacerbate the public health crisis by exposing inmates to the virus, she said. “This policy is in place for now as an attempt to save lives,” Mosby told Marijuana Moment in response to a query about whether people should be prosecuted for drug offenses in general, outside of the current public health crisis. “We will assess the...

Canadians Complain That Legal Weed Still Isn’t as Good as Black Market Bud
(ACB, Branding, Canada, Cannabis, CGC, Distribution, Greenhouses, Products, Regulations) Canadian cannabis firms are seeing a significant downturn in stock market value, but if you were looking to simply blame market forces for the industry’s cannabis business woes, you might be missing the forest for the trees. According to a new report from The Guardian , cannabis consumers in the Great White North say that inconsistent, mid-grade cannabis sold with little-to-no branding has soured legal buyers, often pushing them back to the country’s still-thriving black market. “The government’s pot is too expensive,” one Vancouver Reddit user wrote about the province’s legal weed . “The government doesn’t show you a picture of what you’re buying before you buy it, so you cannot be informed as a consumer. The government weed has been full of bugs, moldy, or too dry in some cases, and often takes too long to get there.” Of course, when Canadian pot users and Reddit posters talk about “government pot,” they are referring to legal weed produced by privately-owned or publicly-traded...
